Terms and Conditions

1. Definitions

1.1.”Carer” means you or the person/persons who attend the course or any part of it with the member.

1.2 “Parent” means a parent or legal guardian who will be responsible for the payment of the Fees and who is the contracting party to this contract.

1.3” Member” means the child named on the registration form and who attends the course.

1.4 “SMART SPORT COACHING LTD”, “we” or “us” means SMART SPORT COACHING LTD , the company or person with whom you have entered into this agreement.

1.5 “Coach” means the individual(s) employed by SMART SPORT COACHING LTD to teach the course. Whilst consistency is sought, SMART SPORT COACHING LTD retains the right to change the coaching staff where necessary.

1.6 “Course” means the SMART SPORT COACHING LTD course as set out on the Programme.

1.7 “Venue” means the place where the course takes place.

1.8 “Registration Form” means the form relating to the registration or re-registration of the member on the course, which has been completed and signed.

1.9” Fee” means the price per course as set out on the registration form.

1.10 “Terms” means the terms and conditions set out in this document.

2. Acceptance of Terms and Conditions

2.1 The terms shall be deemed to have been accepted by the Parent/Carer upon the payment of the Fee by, or on behalf of the Parent/Carer.

3. Fees and Payment

3.1 To be certain of their inclusion on the Course, the Parent shall pay the Fee to SMART SPORT COACHING LTD PRIOR to the Member commencing the Course.

3.2 Refunds or pro-rating of fees for missed sessions due to your own circumstances will not be issued.

3.3 Payments will be returned if a session has to be cancelled due to minimum numbers not being achieved.

3.4 In the event of a serious illness/accident where a number of sessions are to be missed, a credit note may be issued. SMART SPORT COACHING LTD may request a medical certificate to be produced.

3.5 If there are any sessions missed due to adverse weather conditions, SMART SPORT COACHING LTD may at its discretion, offer a make-up session, or parents will be refunded for the session missed. 

4. Cancellation, pausing and re-enrolment

4.1 SMART SPORT COACHING LTD may cancel this contract before the start of any Term. In such event SMART SPORT COACHING LTD will refund any fees for outstanding Sessions.

4.2 In the event that Sessions are cancelled due to local authorities deeming the grounds unplayable, no refund will be given. SMART SPORT COACHING LTD may defer, or credit, one Session per Term if a succession of Sessions are cancelled in that one Term. During adverse weather conditions, Parents will be advised in case of possible cancellations.

4.3 In the event of a lockdown caused by Covid-19 or any other pandemic, SMART SPORT COACHING LTD will refund, pro-rata, the registration fee (less a £10 charge, per registration, for administering each refund) for the sessions missed during that Term. Since the length of the lockdown period will be unknown, refunds will be made at the end of the Term.

4.4 Parent must provide a minimum of 30 days notice by emailing coaching.smartsport@gmail.com before the next subscription payment due date (1st of the subsequent calendar month) should they wish to cancel or pause their subscription, otherwise the next subscription payment is payable in full. All other Terms remain unchanged in that regard.

4.5 No refunds, or credits (pro-rating) will be issued in any other circumstances.

4.6 If after cancelling or pausing their subscription, Parent wishes to re-enrol in the month immediately subsequent, the full monthly subscription fee will be payable, irrespective of when their child re-joins in the subsequent month, even where sessions in that month may already have passed.

5. Parent’s Responsibility

5.1 The Parent acknowledges that the information set out in the registration form (whether or not completed and/or signed by the Parent) is accurate in all material respects and that the Parent will inform SMART SPORT COACHING LTD of any changes immediately.

5.3 The Parent shall indemnify and keep SMART SPORT COACHING LTD indemnified against all loss, liability, costs and expenses which SMART SPORT COACHING LTD may incur directly, or indirectly as a result of any action or inaction of the Parent, the Carer or the member.

5.4 Whilst the Parent acknowledges their child under the direction, care, and control, of the Coach, Parents/Carers should be nearby to ensure their child stays within the boundaries demarcated by SMART SPORT COACHING LTD.

5.5 Parent must declare if they do not want their child to be photographed for marketing use, and keep us up-to-date should this change using the given email address or phone number.

5.6 Parent must drop-off and collect their child from their chosen session at the allotted and start and finish times. A child may be excluded from participating in a session due to late arrival, with no refund offered.

5.7 Parent accepts to pay late collection fee of £5 per child if child is collected later than 10 minutes after the end of the allotted session time.

5.8 Parent acknowledges that child will not be released by Coach at end of session to anyone other than the named Parent/ Guardian. Any variation to peron collecting child from session (other than the Parent) must be communicated to SMART SPORT COACHING LTD prior to commencement of the session.

5.9 Parent accepts to ensure that their child is wearing appropriate clothing, footwear and protective equipment for all activities.

6. Health

6.1 The Parent shall inform SMART SPORT COACHING LTD and the Coach of any medical condition physical or behavioural, or injuries that the member may have, prior to the start of the Term. If there are any health concerns that may affect participation within the Session, it is advisable that a GP’s advice is sought. If a child has an epi-pen this must be kept on the premises with a Parent who is close by at all times.

6.2 In the event of the Child having specific additional needs that cannot be catered for in our sessions, SMART SPORT COACHING LTD will advise Parent. Child’s continued participation will be at the sole discretion of Coach, whose decision will be final.

7 . Discipline

7.1 In the event that SMART SPORT COACHING LTD determines the behaviour of the member and the Parent/Carer to be unacceptable, SMART SPORT COACHING LTD shall be entitled to exclude the Member and the Carer (or either of them) from Course and Premises permanently, or for such period as SMART SPORT COACHING LTD shall (in its entire discretion) determine, without a refund.

7.2 The standard of behaviour which is to be regarded as unacceptable at a Course or on Premises shall be determined by SMART SPORT COACHING LTD but shall include damage to property, disruptive behaviour, aggression toward the coach, or other members.

8. Exclusion of Liability

8.1 Except in the case of fraud, SMART SPORT COACHING LTD, and its coaches, accept no responsibility under any circumstances for any loss (consequential or otherwise), damage, expense or delay suffered or incurred by the Parent, the Member or any other party arising directly or indirectly or in any way connected with the attendance of the member at the Course (or any part of it) or any other act or omission on the part of SMART SPORT COACHING LTD or any of its coaches, even if such act or omission is negligent.

8.2 The Parent agrees (for and on behalf of the Parent and the Member) that any claim by the Parent or the Member against SMART SPORT COACHING LTD or any coach, Employee, of SMART SPORT COACHING LTD must be brought within 60 days of the event that gave rise to such claim. Any claim made thereafter shall be time-barred.

8.3 The Parent acknowledges, warrants, and undertakes (for and on behalf of the Parent and the Member) that the maximum aggregate liability of SMART SPORT COACHING LTD to the Parent and/or Member under these terms shall not exceed the Fee.

8.4 SMART SPORT COACHING LTD any of their staff are not responsible for any loss or injury during the session

9. General

9.1 The failure by either party to enforce at any time any one or more of these conditions arising under these Terms shall not be a waiver of them.

9.2 These Terms constitute the entire agreement between the Parent and SMART SPORT COACHING LTD. By making payment of the Fee and the member attending the Session, a Parent is deemed to have accepted these Terms.

9.3 This entire agreement shall be governed by English Law and fall under the jurisdiction of the English Courts.

10. Image photography

10.1 SMART SPORT COACHING LTD adheres to the FA recommended guidelines on photography. These are available here. By enrolling at SMART SPORT COACHING LTD you agree that “SMART SPORT COACHING LTD may use in compliance with FA Guidelines, photographs that include the player”.
